In Guilford County, North Carolina, the Development Ordinance requires any contractor whose project disturbs more than one acre of land to provide an erosion control plan and post a surety bond prior to receiving a grading permit. If you decide to cancel the bond, a written notice must be sent to Jet. We will then send a cancellation request to Guilford County. Please note that the grading permit may be revoked if the bond is not in force, and would not be reinstated until another surety bond is in force.
If for some reason you choose to cancel your bond prior to commencing permitted work, Jet can refund the premium payment once Guilford County releases Jet’s liability. Otherwise, bond premium will not be refunded.
Contractors in Guilford County can avoid claims against their surety bond by simply completing their projects in accordance with the county’s standards, approved sediment control plan, and grading permit. Violations of the sediment control plan or abandoned projects may prompt Guilford County to invoke their right to draw against the surety bond, to include civil penalties that could range as high as $5,000 per day of violation. Be sure to address any outstanding items following an inspection.
If corrective action is not taken following an inspection or the erosion control work is abandoned entirely by the contractor, the county may process a claim against the surety bond directly with Jet. In this event, Jet will thoroughly investigate the validity of the claim.
If the claim is valid, Jet is obligated per Guilford Development Ordinance Section 7-4.12 to pay the claim up to the total sum of the bond. The surety bond acts as a line of credit, and the contractor is responsible to reimburse Jet. The contractor is still responsible for their actions, and will need to reimburse Jet to reinstate their bond, along with their building permit with Guilford County.
Guilford County’s Soil Erosion Control Bond exists as a fiscal tool for Guilford County to utilize to correct negative effects of uncontrolled sedimentation, including pollution, damage to waterways, and wildlife endangerment. Erosion control plans are in place to ensure that improvements will be built that establish protective cover on disturbed land, control the velocity of runoff, and prevent off-site sedimentation. The County needs the Land Improvement Bond as a third party guarantee should contractors who disturb land in the county fail to act in accordance with the plan to control erosion and sedimentation.
The surety company, Jet, guarantees the county will be reimbursed for expenses required to repair the issue. The county does not want to be in charge of repairs and will hold the contractor and any surety company that backs them at fault.

The Land Improvement bond and the associated grading permit are written for one year to cover the duration of a single land development project, but can be renewed for an additional six months if a project extends beyond the first year.
Should a project extend beyond its first year, Jet will notify you via email months before your renewal date. Jet will also refund your premium on a pro rata basis for the portion of the premium not used.
A contractor working on land improvement in Guilford County doesn’t need additional bonding per the Development Ordinance, but some contractors on the job, such as landscape, irrigation, and electrical contractors, are required to hold a bond for their license.
