Virginia Personal Representative Bond
Probate is the legal process of distributing a person’s property after they pass away, ensuring their assets are distributed to the rightful heirs and any outstanding debts are paid. The person who handles this process is called a personal representative, specifically an executor or administrator.
Virginia Code 64.2-504 requires most personal representatives of an estate to post a surety bond with the circuit court before being appointed. The Virginia legislature enacted the surety bond requirement to financially protect the estate's beneficiaries and creditors from any unethical actions of the personal representative.

What is the Required Bond Amount?
Virginia Code 64.2-504 states that the bond amount for personal representatives must equal the full value of the estate’s personal property under their control, at a minimum. However, if the decedent’s will allows the personal representative to sell real estate, the bond amount must cover the full value of all personal and real property in the estate.
The circuit court clerk overseeing your case will set the specific bond amount for each case and can increase or decrease the bond amount upon request of the personal representative, an interested party or at the court’s discretion.

- Determine the Required Bond Amount
The circuit court clerk sets the bond amount based on the fair market value of the estate’s assets listed on the initial petition for appointment. The bond amount must equal the value of all personal property under the fiduciary's control, at a minimum.
- Calculate the Total Cost
Jet Surety charges $85 per year for all personal representative bonds up to $11,000 in size. For each additional $1,000 increase in the bond amount, the bond premium will increase by the corresponding amount outlined in the table below. See the chart below to calculate the price for larger bonds.

Jet does not require credit checks for applicants with bond sizes under $25,000 or under $50,000 if the applicant has retained an attorney. What is the Process of Becoming a Personal Representative in Virginia?
Step 1 – Hire an Attorney
Although not explicitly required, it is highly recommended that personal representatives hire an attorney to assist with the probate process.
Step 2 – Determine Priority
According to VA Code 64.2-502, priority for appointment as a personal representative will be granted to the sole heir of the estate or any heir to the estate who applies and has written renunciations from all other heirs. To qualify for appointment, an individual must be at least 18 years old and be competent to serve as a fiduciary. The circuit court typically looks to appoint an heir in the decedent’s immediate family, such as a surviving spouse or child. Any person nominated as executor in the will has top priority for appointment in a testate administration.
Step 3 – File for Administration with the Court
Anyone seeking to apply for administration of an estate must contact the circuit court in the county where the decedent resided or owned property. A clerk will walk the personal representative through the appointment process, provide them with all required forms, and answer any questions they may have. Applicants must bring the following items to the appointment:
- A certified copy of the death certificate
- Names, ages and addresses of all estate heirs
- The approximate market value of all property owned solely by the decedent
- An original will (if one exists)
- Cash, check, or credit card to pay probate fees
If the personal representative is not a resident of Virginia, they must bring a Virginia resident to either co-qualify or serve as their designated registered agent. The person appointed as personal representative must also take an oath to perform their duties as a fiduciary faithfully. Step 4 – Purchase a Surety Bond
Unless otherwise exempt, personal representatives must purchase and maintain a surety bond (exemptions outlined below).
When is a Bond Not Required in Virginia?
According to VA Code 64.2-505, the court may waive the surety bond requirement for personal representatives in Virginia in the following situations:
- If the will explicitly waives the bond requirement
- If all estate beneficiaries agree to serve as co-personal representatives
- If the estate value does not exceed $25,000 under VA Code 64.2-1411
- The personal representative is a state agency, bank, or trust company
The circuit court clerk may require a surety bond in any of the above scenarios if they deem it necessary for the protection of the estate. In some cases, they may only require a personal bond with no surety which can be obtained directly from the court.
What is the Purpose of a Virginia Personal Representative Bond?
Virginia requires personal representatives to purchase a surety bond as a prerequisite to being appointed as a fiduciary over an estate. The bond protects the heirs, beneficiaries, and creditors of the estate from financial harm if the personal representative fails to abide by the regulations outlined in VA Code 64.2-500 et seq.
Specifically, the bond protects beneficiaries and creditors if the personal representative fails to adhere to all court orders or mismanages the estate’s assets. In short, the bond is a type of insurance that protects the estate if the personal representative violates their fiduciary duties.
What are the Responsibilities of a Personal Representative in Virginia?
Personal representatives in Virginia have several key responsibilities in managing the probate process and settling the deceased person's estate. The primary duties are outlined in Title 64.2 of the Virginia Code and include the following:
- Gather and Inventory Assets: The personal representative must locate and collect all assets of the deceased individual's estate, including real estate, bank accounts, investments, personal belongings, and any other valuable items. Personal representatives must submit an inventory of estate assets to the Commissioner of Accounts within four months of appointment.
- Notify Creditors and Pay Debts: Personal representatives must notify all creditors of the deceased person's passing and give opportunity to submit a creditor’s claim to the Commissioner of Accounts. If the Commissioner determines the claim is valid, the personal representative must pay the claim prior to distributing any assets to heirs.
- File Tax Returns: The executor or administrator must file all required tax documents on behalf of the deceased individual and the estate, including the final income tax return of the deceased and other tax filings necessary. In Virginia, there is generally $1.00 in state probate tax due per $1,000 value of the estate.
- Distribute Assets to Beneficiaries or Heirs: After settling all debts, taxes, and expenses, the personal representative must distribute the remaining assets to the beneficiaries or heirs following the will's provisions or the laws for intestate estates under Virginia law.
- Provide Accounting: The personal representative must thoroughly document all financial transactions associated with the estate. Every year, the fiduciary must file an accounting report that comprehensively summarizes the estate's income, expenses, distributions, and other financial activities. The court must approve the accounting before closing out the estate and canceling a probate surety bond.
How Does the Application Process Work with Jet?

- Applicant’s credit history for bond limits over $25,000 if they have not retained an attorney, or $50,000 if they have retained an attorney

How Do You File a Personal Representative Bond with the Circuit Court?
Virginia courts require the surety company to physically sign the probate bond at the courthouse during the formal qualification appointment. Due to this requirement, Jet typically requires an attorney to be hired or retained by the personal representative before issuing a probate bond in Virginia.
Jet (the Surety) and the personal representative must sign the original bond. Jet fills out the bond form, signs as the Surety, and sends the original bond to the representative to sign and file the completed bond with the circuit court. The court may require Jet to verify the authenticity of the bond. Jet will also send the representative an electronic copy of their bond for reference.
Important Terms to Know in Virginia Probate
- Probate: The legal process through which the administrator or executor distributes all assets and pays all debts of a decedent’s estate under the supervision of the court.
- Settlement: The act of distributing the assets and settling the debts of the estate.
- Fiduciary: The person in charge of settling the estate. The definition includes all executors and personal representatives of an estate.
- Petition: A verified application submitted to the court requesting appointment as a fiduciary of the estate.
- Decedent: The individual who has passed away and left the estate.
- Beneficiary: Any person entitled to any part or all of an estate. This is also referred to as an heir.
- Creditor: Any person having a claim against a decedent's estate.
- Testate: If the decedent dies with a will, the estate is considered Testate. Typically, individuals name their desired executor in the will.
- Intestate: If the decedent dies without a will, the estate is considered Intestate, and the personal representative must petition the court for appointment.
- Surety Bond: A type of insurance required for New Jersey fiduciaries that guarantees they will faithfully fulfill their duties to settle the estate.
How Do You Renew the Virginia Personal Representative Bond?
Jet will notify the administrator well in advance of the renewal date to ensure timely renewal payment. Jet will notify the attorney (when applicable) and the court if you do not pay for the renewal. If an attorney is involved, they may decide to pay the renewal bond premium, but the fiduciary must reimburse them. Upon being notified of failing to maintain the bond, the court may schedule a hearing to remove the fiduciary for not meeting court requirements.
How Long Do You Need the Virginia Personal Representative Bond?
The court will release the bond once the personal representative has paid all debts, distributed all assets, and provided a final accounting approved by the court. The personal representative must submit an annual accounting to the court if the estate settlement extends beyond a year.
After obtaining the notice of release, the personal representative simply needs to email a copy to [email protected] so that we can cancel the bond and issue any applicable refund due back to the personal representative.
What Actions of a Personal Representative Can Lead to Surety Bond Claims?
Personal representatives have a critical role in the settlement of an estate and are relied on by the heirs, creditors, and the probate court to fulfill these obligations. Anyone appointed as a personal representative must adhere to all court orders and ensure they fulfill all responsibilities outlined in Title 64.2 of the Virginia Code.
Some examples of potential actions that could cause a claim:
- Committing negligence, embezzlement, or fraud
- Buying or selling any part of the estate without authorization from the court
- Misusing or misappropriation of estate assets, such as mixing estate and personal funds
- Failing to distribute estate assets to its legal beneficiaries
- Acting outside of the powers specifically vested by the court
- Nonpayment of any estate taxes and debts
An heir or creditor to the estate with proven financial damages caused by the personal representative may file a claim against their bond. While most personal representatives act with good intentions, occasional mismanagement or errors in accounting can lead to significant challenges for well-intentioned fiduciaries. To avoid these issues, we highly recommend that personal representatives retain the services of an attorney to assist in managing the case.
What Happens if a Claim Is Filed on the Probate Bond?
Upon receiving court notice of a claim on the bond, Jet has 30 days to pay the claim or ask for additional time to review it. Jet works tirelessly to protect our clients against faulty claims, so even if the court has requested a bond payout, we assess all documentation provided by the court and the fiduciary before paying out the claim. However, if a claim is valid and Jet pays the claimant, the personal representative must pay Jet back as the representative is ultimately liable for their own actions.
