The Texas Department of Motor Vehicles (TxDMV) requires truck drivers and haulers to obtain a permit and surety bond when transporting overweight or oversized vehicles/loads across city, county, or state roads and highways. Depending on the weight and size of the vehicle/haul, the applicant will either need a $10,000 Superheavy or Oversize Annual Permit Bond or a $15,000 Over Axle and Over Gross Weight Tolerance Permit Bond.

A driver will need the Super Heavy Single-Trip Permit and accompanying surety bond for the transportation of a non-divisible vehicle (non-tractor trailers) and/or load that exceeds a total gross weight of 254,300 pounds. This means the vehicle/load cannot be separated in order to create a lower or more manageable weight. Single-trip permits may only be used once for the specific route and schedule that was approved by the Texas Department of Motor Vehicles. However, the Superheavy or Oversize Bond will not expire until August 31st of its effective year and may be renewed with Jet for future single-trip permits. A driver will need an Annual Over Axle/Over Gross Weight Tolerance Permit and the appropriate bond for the movement of divisible commodities (a commercial motor vehicle, trailer, semitrailer, or combination of those vehicles). The vehicle(s) may exceed the allowable axle weight tolerance by 10% and may exceed the gross weight tolerance by 5%. It is important to note that a few cities and counties in the State of Texas require drivers to obtain additional oversized or overweight surety bonds if they are transporting such vehicles or loads on their local roadways. The TxDMV gives you the option to submit your permit application by mail (along with your bond form) or you can apply for the necessary permit through their online TxPROS system. The choice is yours!
The Superheavy or Oversize Annual Permit Bond expires on August 31st each year (this means your bond will not be up for cancellation). If you are looking to apply for a new permit, you will need to acquire a new surety bond as well. With this in mind, the Jet team will send you an invoice for your bond before its official expiration date. All you need to do is fulfill the payment and you will receive a new bond for the year.
As for the Over Axle and Overweight Tolerance Bond and permit, renewal for both is required annually. Jet will send you a renewal invoice by mail and email far in advance of your bond term expiration date. Just complete payment and your bond will remain active with the TxDMV for another term.
If you ever need to cancel the Over Axle and Over Gross Weight Tolerance Bond, you may send us a cancellation request to [email protected] at any time. Once received, we will send a termination notice to the TxDMV and the liability of your bond will be released within 30 days of notification.
Drivers of oversized and overweight vehicles or loads must follow all regulations pursuant to Chapter 623 of the Texas Transportation Code as it pertains to the rules of their permit. The permittee is also expected to comply with the Texas Department of Motor Vehicles approved route and schedule. A violation of these obligations may result in large fines, a revoked permit, refusal from the TxDMV to issue future permits to the individual, and/or a bond claim.
Claims on either the Superheavy/Oversize Bond or the Over Axle/Overweight Tolerance Bond will only occur if the permittee causes damages to a city, county, or state roadway, highway, bridge, or structure within their approved route and fails to take responsibility for their actions by paying back the State for the damages caused. If this occurs, the TxDMV will file a claim on the surety bond to cover the costs of restoring the damaged area to its previous condition.
If you receive a claim notice from the Texas Department of Motor Vehicles, immediately contact Jet. We will ask that you provide us with all available information and documentation regarding the claim. These tools will be used for our own investigation of the alleged violation.
Per the surety bond forms, Jet is legally obligated to payout all justified claims up to the bond limit. Claim payments will never exceed the bond amount. You, the permittee, are held responsible for your actions and must reimburse Jet for the claim payout made on behalf of your transgression. Failure to fulfill this obligation may lead to future difficulties in acquiring surety bonds within the State of Texas, specifically bonds that are required to be approved for a superheavy or overweight transportation permit.
As stated earlier, certain cities and counties in the State of Texas require drivers to obtain an additional superheavy or overweight bond if they are transporting a vehicle or load on a local city or county roadway.
