The City of Temple, Texas has two possible bonding requirements a contractor may need to obtain when performing permitted road or public work in the City. First, a $3,000 Street Contractor Bond is required for the City’s protection from damages arising from defective or faulty workmanship. Second, a $2,000 Right-of-Way Permit Bond is for the City’s financial protection should a contractor not follow ordinance/permit requirements or doesn’t return work areas to original conditions.
Nearly all applicants will qualify for the $100 bond rate. *However, Jet requires a soft credit check as there are some tolerances that need to be cleared before we can release a bond at that rate.

The Right-of-Way Bond form that is required by the City has some interesting provisions that we hope are never needed (as they are indications of a bond claim). First, the bond has a 1-year tail, meaning the City can file a claim for issues that arise from the job site up to a year following completion. Second, the City can make multiple claims upon the bond stemming from multiple infractions. Meaning the City can ultimately collect more than the $2,000 limit on the bond.
Before contractors think the bond is a ticket to freely cause issues and never clean up the mess, they should think again. The only way a bond is offered, by any surety company, is to receive indemnification from the contractor. Even without signed agreements, the law is tight on this. What does this mean? It means that the contractor needs to pay back the surety company. Why have a bond then? Because the City of Temple needs a third party to guarantee the payment, there is a chance the contractor won’t make restitution for the damages they caused.
