The main purpose of the Sidewalk and Approach Bond is to protect the City of Sachse and its residents from financial harm in cases where the contractor commits a permit violation or refuses to repair any physical damages that are caused. If such transgressions occur, funds from the permit bond will be used to cover financial losses and/or the cost of hiring a new contractor to take over the construction project.
The right-of-way permit allows the contractor to perform construction, reconstruction, and/or repairs of public sidewalks or driveway approaches. Once construction has been completed and approved by the City Engineer, the contractor will be expected to maintain the job site for a period of two years. If the City finds that unforeseen damages have been caused to the project area or that construction was done improperly and is now degrading, they will send a maintenance request to the contractor that must be completed within 10 days of the notice. Not fulfilling this maintenance obligation within the required timeline is a permit violation and the Public Works and Engineering Department has every right to file a claim on the contractor’s bond to cover the financial losses they have incurred.
So if you receive a simple maintenance request to redo a section of the sidewalk due to cracking in the concrete, it is in your best interest to complete these repairs immediately. Otherwise, you may face permit penalties and/or a pricey bond claim.
