The Right-of-Way Bond is required by the Richardson Capital Projects/Engineering Department as a way to financially ensure that the contractor will perform the sidewalk, curb, gutter, and/or driveway approach project up to the standards of the permit, as well as fulfill any contractual obligations required of them. To put it simply, if you fail to uphold any of these stipulations, the party that hired you (e.g. the City themselves or a local resident) may file a claim on your bond to cover any financial harm that has occurred.
For example, the right-of-way permit comes with a five-year maintenance condition. This means the contractor will be expected to perform any necessary repairs upon the construction project area within ten days of receiving a maintenance notice from the City Engineer. The maintenance request could be something straightforward such as filling cracks in a sidewalk or something a little more difficult like replacing an entire concrete slab of the sidewalk. Due to such a long maintenance period, it is common for contractors to forget about or just blatantly ignore their maintenance obligations. If this occurs, the damaged party has every right to file a claim on the permittee’s Right-of-Way Bond. Funds from the surety bond are typically tapped to cover any financial losses incurred by the damaged party and may also be used to hire a new contractor to take over the job.
