A Medicaid Provider Bond may be required by durable medical equipment (DME) providers and non-government ambulance providers in Texas Medicaid or the Children’s Health Insurance Program (CHIP). The bond is used to guarantee that the Texas Health and Human Services Commission (HHSC) will receive uncollected overpayments from the provider.

The premise of the Medicaid Bond can be boiled down to one action — collect all overpayments and submit them to the HHSC. Any missing overpayments will be reported by the HHSC to the Office of Inspector General (OIG) to recoup overpayments. The OIG will send notice to the provider, holding them responsible for fulfilling the payment. Failure to comply will result in claims on the bond. Surety bond requirements are listed in Title 1, Rule 352.15 of the Texas Administrative Code.
