Contractors that are proposing a construction project that is to be completed on a public street, highway, sidewalk, or alleyway within the City of Laredo, Texas must apply for a permit with the local Building Development Services Department. To be eligible for such a permit, and to maintain it, a $10,000 Right-of-Way Bond will be required of the contractor.

The Right-of-Way Bond is required by the Laredo Building Development Services Department to act as a financial guarantee in cases where the contractor commits negligence, poor workmanship, a breach of contract, or any other kind of permit transgression. The surety bond essentially protects the city and its residents from financial harm if a contractor violates regulations and then refuses to or is unable to resolve the damage they have caused.
To avoid a bond claim, the contractor should follow all permit regulations pursuant to Division 4, Section 28 of the Laredo, Texas Municode, as well as fulfill any contractual obligations that were agreed upon with the customer. Right-of-Way Permit Bond claims are rare, but if one does occur it is likely due to poor workmanship and/or failure to perform necessary maintenance on the completed construction site.
If the City finds that some kind of maintenance work needs to be performed such as the restoration of a negligently constructed sidewalk, the Department will send notice to the contractor to restore the damaged area up to regulation standards within a certain period of time. Only one notice will be sent. If the contractor fails to fulfill this request, the city has every right to file a claim on the contractor’s Right-of-Way Bond to cover the cost of hiring a new contractor to complete the work properly.
According to the Building Development Services Department, the City of Laredo also offers contractors the opportunity to file an annual $100,000 Right-of-Way Blanket Bond rather than the $10,000 Right-of-Way Bond. The blanket bond would cover the contractor’s full year of right-of-way projects while the other bond just covers one project at a time.
