A guardian, otherwise known as a fiduciary, is appointed by a probate court to care for a minor or an incapacitated person (often referred to as a ward), the person’s estate, or both the protected person and the estate. In order to guarantee that your duties as a fiduciary are performed without financial damages to the minor/ward, Texas probate judges often require the security of a surety bond.

The Guardian Bond has a required limit that is determined by the Texas probate court in charge of your case. Typically, the amount of the bond must be sufficient enough to protect the guardianship and the protected person’s creditors. For example, fiduciaries that are acting as guardians of an estate need a bond limit that is equal to the estimated value of the entire estate. This includes physical personal property and any revenue anticipated to be made during the following 12 months of the estate guardianship.

The probate court will provide the guardian with their required bond amount when the judge evaluates the ward’s assets based on the guidelines outlined above.
Guardian bonds up to $17,000 in size will cost as low as $85 per year. For each additional $1,000 increase in size, the bond premium for preferred customers will increase by the corresponding amount outlined in the table below.

Jet does not require credit checks for applicants with bond sizes under $25,000, or under $50,000 if the applicant has retained an attorney. The role of a guardian, sometimes referred to as a conservator, may be achieved in a number of ways. A guardian may be appointed by a probate court on its own motion, through a legal will left by the parent of the protected person, or the court may accept the application from an adult individual to be a guardian of the ward and/or their estate.
As for the duties of a guardian, the specifications of each role vary but the general details for each fiduciary type and what tasks they are in charge of can be found listed in the chart below.

A guardian is appointed by a probate court to care for and manage everyday choices for a protected person and/or their estate. This includes making financial, health, and other major life decisions that will have a lasting impact on the ward and/or their estate. Due to the serious nature of this position, the State of Texas may require a surety bond to be acquired for guardianships. The Guardian Bond provides protection for the ward and/or their estate by acting as a financial guarantee in cases where the fiduciary does not uphold that probate court’s and State’s guardianship standards.
In some cases, there are exemptions to the surety bond requirement. Fiduciaries that meet any of the following qualifications are generally exempt from the Guardian Bond mandate.
The probate court may still require a bond in any of the above cases if they feel that the Guardian Bond is necessary for the sake of the protected person and/or their estate.

The original signed and sealed Guardian Bond form must be filed with the local County Clerk Office that is overseeing your guardianship, which is typically located within the county that the ward and/or estate resides.
Once you have officially purchased the Guardian Bond, a Jet team member will fill out and seal the bond form appropriately, and then send it to your address of choice. At this point, it will be up to you (the fiduciary) to sign the form and complete the bond filing process.

If you ever need to cancel your Guardian Bond, you may request to do so with Jet by sending a written cancellation appeal to our company email: [email protected].
However, cancellation is not so simple. Once the Jet team has received your notice, we will then send a cancellation request to the probate court in charge of the guardianship. If the judge accepts the request, the bond will be officially cancelled as soon as Jet receives a release of liability.
Until your obligations as a fiduciary have been fulfilled, you will be required by the judge to file a new surety bond with the probate court before your previous bond may be cancelled. Failure to do so promptly will lead to the probate judge removing you from your fiduciary position and releasing your surety company (Jet) from future liability.
The Guardian Bond must remain in effect for the entirety of the fiduciary acting as a guardian. According to Section 1201.002 of the Texas Statutes, Estate Code, the probate judge will conduct an annual check-up regarding the well-being of the ward and/or estate, as well as the status of the bond. This means the renewal of your surety bond will be likely.
When it comes to renewing your bond, Jet will send you a renewal invoice far in advance of the bond term’s expiration date via mail and email. The bond will remain active with the probate court as long as you complete the standard payment due. The first year is fully earned, but subsequent bond terms can be cancelled on a prorated basis.
As for when your position as fiduciary ends, this will only occur when all guardian duties are complete and you have been officially released by the probate court of your position (early resignation as a fiduciary is also possible).
If any of the following scenarios occurs, the fiduciary will be released from their guardianship role:
Guardian of a Minor- A guardianship shall be settled and closed if the minor reaches 18 years of age, if the minor marries and the spouse qualifies as a guardian, if the child’s minor status has been legally removed (emancipation), or if the protected person dies.
Guardian of an Incapacitated Person- A guardian will be released of their duties if the court determines that the ward is now restored to full capacity and can take care of themselves, if the incapacitated person has died, or if the court finds that a guardianship of the protected person is no longer necessary.
Guardian/Conservator of an Estate- Fiduciary duties may be settled if the ward’s estate is exhausted, the foreseeable income accruing from the estate is so small that maintaining the guardianship is more burdensome than helpful, if all assets of the estate have been placed in a management trust, or if the estate is officially closed.
As your role as a guardian comes to an end, it is typical for the probate court to hold a final account review of the guardianship to ensure that you have met all ordered obligations regarding the ward and/or their estate. If approved, your fiduciary status and surety bond will be officially released by the judge.
The role of a guardian is a big responsibility. One that is filled with life-changing decisions and likely conflict from others that have self-interests regarding the guardianship. Therefore, acting in accordance with Title 3 of the Texas Statutes, Estate Code, and the probate court’s requirements is in the best interest of you, the protected person, and/or their estate. Fiduciaries often choose to work alongside an attorney to ensure they are fulfilling their duties up to regulation standards.
As for why a claim may be filed on the Guardian Bond, take a look at the common causes listed below:
A claim may be filed on the Guardian Bond by any person that feels they have been damaged by the fiduciaries actions regarding the guardianship. This includes the protected person themselves and any other person that has been financially injured due to a breach of the probate court’s regulations. The claimant must take civil action with the probate court directly. It will then be up to the judge to decide whether the claim is justified and if restitution by means of the surety bond is appropriate.
If the probate court decides to go through with a claim on your Guardian Bond, they will send a claim notice to Jet promptly. Once received, the Jet team will conduct a review and investigation of the claim to determine if it is justified or not.
Per the Texas Guardian Bond form, valid claims must be paid to the claimant in the penal sum ordered. However, claim payouts will never exceed the bond’s limit. As a guardian, you will be held responsible for your actions and will ultimately be required to reimburse Jet Insurance Company for the full claim payout amount.
