Contractors working on cables, pole lines, or conduits in or around public roads in Fort Bend County will need to file a Performance Bond (sometimes called a Right-of-Way Bond) to obtain their permit. The bond acts as a precaution against loss and damages from the contractor’s failure to complete the job.
Fort Bend County allows contractors to file either a Performance Bond or Perpetual Bond. A Performance Bond is used for a single project whereas the Perpetual Bond covers you in perpetuity.
This Right-of-Way Bond can start as low as $100, but can vary based on the bond limit and other underwriting factors. Typically, the bond limit and a soft credit check (don’t worry, it doesn’t impact your credit score like a hard inquiry) will be enough to get a quote for lower bond limits.

The reason that Fort Bend County needs a Right of Way Bond to be filed before work can begin in County-maintained roadways is to cover losses or damages in the event that the construction is not completed according to the right of way permit. The contractor must complete the installation or maintenance of conduits, cables, or pole lines in or around commercial driveways, median openings or County roads; if the project can’t be completed, the contractor must reimburse the County for the cost of finishing the job. A contractor who does not fulfill these obligations can receive a claim on the Right of Way Bond.
