What Size Bond Do You Need?
As a rule, surety bonds cost just a small portion of the required bond limit. This is good news for those needing an Administrator Bond or Executor Bond, as the bond limits can be several hundreds of thousands of dollars. The limit for Probate Bonds is determined by the judge that issues the letters of administration and will be an adequate amount to protect the estate and its creditors. The judge may consider, for example, the amount of cash, the value of stocks, bonds, or other securities, or the estimated value of personal property to get an approximate value of the estate.
What Is the Cost of an Administrator/Executor Bond in Texas?

- Determine the Required Bond Amount
The judge presiding over the case will provide the administrators and executors with their required bond amount based on the value of the estate's assets.
- Calculate the Total Cost
Administrator bonds up to $10,000 in size will cost as low as $85 per year. For each additional $1,000 increase in size, the bond premium for preferred customers will increase by the corresponding amount outlined in the table below.

Why Are Probate Bonds Required of Administrators and Executors in Texas?
A Probate Bond, regardless if it is an Executor Bond or Administrator Bond, is a way to counteract the possible financial damage caused by an administrator or executor that poorly carries out their duties, whether it is unintentional or by ulterior motives. The administrator/executor is responsible for enforcing the last wishes of the person who has passed, in a manner that a sensible person would care for their own wishes or estate.
Failing to properly distribute the estate can result in financial damage to “interested persons”, or people who would have some kind of claim or property right against the estate. The State of Texas set up this bond requirement to allow for beneficiaries to seek compensation for the lost value caused by the personal representative.
Is a Probate Bond Always Required for Administering/Executing an Estate?
Not always. An executor of a will does not need to file a bond if the will expresses a bond is not needed or if the representative is considered qualified by the judge. For example, a personal representative does not have to submit a bond if they are a corporate fiduciary. However, if an executor exempt from the bond requirement is mismanaging the estate, the County Clerk may then enforce a bond requirement to protect against future financial damage.
What Is the Difference Between an Administrator and an Executor?
Although they are both charged with managing the estate, an administrator is assigned when the deceased has passed away without leaving any will whereas an executor has been specifically named in the will as the personal representative for the deceased.
Other Important Terms to Know
- Probate: The legal process the estate of a deceased person must go through so that all assets can be distributed and all debts be paid
- Settlement: This is the act of distributing the assets and settling the debts of the estate
- Decedent: The individual that has passed away and left the estate.
- Testate: If the decedent dies with a will, the estate is considered Testate and the executor should be named.
- Intestate: If the decedent dies without a will the estate is considered Intestate and the administrator will petition the court for appointment.
- Surety Bond: A type of insurance required for all Texas administrators and executors that guarantees they will faithfully fulfill their duties to settle the estate.

How Does the Probate Bond Get Filed?
The bond must be filed with the county clerks. Once you have purchased your Probate Bond, Jet will prepare your bond form and mail it to you. You will need to sign the bond and submit the original copy to your local county clerk.

What Happens if I Need to Cancel My Probate Bond?
There may be a time when you need to cancel the Probate Bond. If so, make sure to send Jet an email at [email protected] to get the process started. Typically, the County Clerk’s Office will require a request for cancellation before cancelling the bond. Jet will not be able to process any cancellation without the County Clerk’s release of liability.
Once cancellation is approved, Jet will calculate the amount of time used on the bond versus the amount of time you paid for. Although the first year of a bond is fully earned, any remaining time will be counted towards a pro-rated refund.
When Does the Probate Bond Obligation End?
Administrators and executors must have a Probate Bond in full force and effect as long as they are executing the estate. When there is no property left of the estate or the estate has been fully administered, the estate will be considered closed and the personal representative can be relieved from their position as administrator or executor.
How Does a Personal Representative Avoid Probate Bond Claims?
Simply put, the personal representative must carry out their duties when executing the estate, but what does that mean? These duties can be found in Title 2, Subtitle H of the Estates Code and specifically Chapter 351 of the Texas Estates Code. These actions must be considered beneficial to the estate and are subject to court approval before the representative can proceed. Here are some examples:
- Purchase property
- Exchange property
- Compound bad/doubtful debts that are owed to the estate
- Abandon the management of estate property deemed burdensome or worthless
As a preventative measure, the administrator or executor of the estate should keep a detailed record of any transactions. This could be used as evidence in their defense in case any accusations of embezzlement or mismanagement arise from interested persons or beneficiaries of the estate.
What Happens if I Get a Probate Bond Claim?
Typically, any complaints with the administrator’s or executor’s execution of the estate are brought before the County Clerk. If there is merit to the complaint, an investigation will be done. If the violation is covered under the bond, a claim on the Probate Bond can be filed.
In the event of a bond claim, Jet will review the case but more often than not, the County Clerk’s decision holds up. Jet will be obligated to provide compensation to the injured interested person or reimburse the estate.
