The City of Clayton uses the Excavation and Restoration Bond to make sure that contractors who excavate streets or any other public right of ways will restore the roadways to an operable condition. If they violate the obligations of their contract or the provisions found in the Streets, Utilities, and Public Services Code, the City, or anyone else who was injured by such violations can lay claim on the bond for reparations. Damage can be caused by the contractor’s willful or unintentional negligence, but neither removes the contractor from liability.
The bond is a requirement for a contractor to receive an excavation permit. The bond is active for one year from the date it was put into effect and allows the contractor to work on excavations, restorations, or other improvements during this time.
