Windermere, Florida Surety Bond Details

Contractor's Surety Bond

Contractor’s working within the Town of Windermere are required to obtain a $10,000 Contractor’s Surety Bond. As long as contractors complete their work in a timely manner and up to code, bond claims can be avoided. If the Town finds any issue with construction and the contractor refuses or fails to address the issue, the bond can be tapped for reimbursement to complete said issues. The bond term ends September 30th and must be renewed annually. 

Communications Services Provider Bonds

  1. Right of Way Bond for Development - This $15,000 bond is conditioned upon the completion of construction within any rights-of-way to its original (or better) condition by communications services providers. Claims would arise for failure to fulfill those requirements. Six months after completion and inspection of the right-of-way, the bond may be reduced to $5,000. The bond must be in place for no shorter than 12 months.
  2. Right of Way Performance Bond - Any communications services provider must obtain a Performance Bond prior to placing or maintaining an initial build, substantial rebuild, extension, or upgrade of its system. The bond is also required when 1,000 feet of open trenching in a right-of-way is shown in the construction plans. Providers that do not uphold the Town’s code may have a bond claim thrown at them so the Town has a way to restore any unfinished or otherwise damaged structures/roadways. This bond is to be on file for no less than 18 months.
  3. Security Fund Bond - Providers of communications services must file a $25,000 Security Fund Bond which ensures there is recompense for damages, should the provider fail to comply with the Windermere Communications Right-of-Way Utilization Ordinance. The bond is to be maintained until the latest of the following: (1) the effective date of transfer/sale/assignment by the provider of all facilities in the rights-of-way, (2) 12 months following the provider’s facilities' total removal or abandonment from the rights-of-way, or (3) six months after termination of registration.

Claims or Collection Agency Bond

Claims agencies and collection agencies, not including bankers, lawyers, etc., must file a $500 surety bond with the Town of Windermere.
