Before any construction on a surface water management system may begin, the property owner or developer must file a construction permit with the local St. Johns River Water Management District. Once the alteration or repair work has been executed and the District determines that all permit obligations have been satisfied, the construction permit will be converted to an operation permit and the property owner or developer will be responsible for the operation and maintenance of the system for a 10-year period.
Throughout the entire duration of either construction or operation permit, a Surface Water Management Surface Bond must be held by the property owner or developer.
The Surface Water Management System Bond limit is determined by your local Water Management District Office and is required to be in an amount that may sufficiently cover the cost of operations and maintenance of the system for the mandatory 10 years.

The original signed and sealed Surface Water Management System Bond, along with any required permit paperwork, must be submitted to your local St. Johns River Water Management District Office. The property owner or developer is expected to fulfill the obligations of their construction and/or operations permit, as well as follow all regulations pursuant to the Management and Storage of Surface Waters Applicants Handbook. Should a permit violation occur and remain unresolved by the property owner or developer in charge, the District may file a claim on the Surface Water Management System Bond. Funds from the bond will be transferred to the District’s standby trust fund and will be used to pay for a new entity to perform operations and maintenance upon the surface water management system.
It is important to note that your Surface Water Management System Bond may not be terminated unless you have provided the District with a new surety bond within 90 days of notifying them of your intentions. Failure to fulfill this requirement may lead to a claim on your current bond.
