The St. Augustine Public Works Department requires communications services providers to obtain a $50,000 Right-of-Way Bond before the construction, maintenance, or restoration of a communications facility within a public right-of-way area may begin. Other licenses and permits within the City may be required as well, generally for contractors.
Surety bonds provide a means of restitution for the City should obligations not be upheld by the licensee/permittee.
Prices for surety bonds are based on the bond limit and sometimes a soft credit check. For example, the $50,000 Right-of-Way Bond starts at $250 for a one-year bond term, but a credit check is necessary due to the larger limit.

For Right-of-Way permit applications and other documents, take a look at the City’s Document Center webpage. It is important to note that the Right-of-Way Bond can cover multiple right-of-way permits obtained by the communications service provider for the year.
According to the Public Works Department, the Right-of-Way Bond must remain active for the duration of the work permit(s) and for 12 months following the completion of the construction or maintenance project. The communications services provider, and the contractor hired on their behalf, must uphold all permit terms and conditions, as well as follow regulations pursuant to Chapter 13 of St. Augustine, FL Municode.
If the Public Works Department finds that the public right-of-way area has not been restored to its original or a better condition once construction or maintenance work to the communications facility has been completed, a claim may be filed on the Right-of-Way Bond. In most cases, funds from the bond will be used to remove the communications facility from the right-of-way and/or to hire a contractor to restore any city property affected by the communications services provider’s permit violations.
A renewal notice is sent to you prior to the renewal date of the bond (typically 1 year after purchase) via email and mail. If your bond has to be renewed, you’ll be able to click the link in the email, call us, or submit payment through standard mail.
If for some reason you need to cancel the bond before the 1-year mark, email us at [email protected]. Some bonds have a cancellation period, such as 30 days, where the bond is still active once the City receives notice of cancellation from Jet.
Regarding claims, you can avoid them by following St. Augustine, FL Municode sections that are applicable to your license or permit. In a basic sense, don’t commit fraud or negligence, and you should be good.
