A Right of Way Permit Bond is required of contractors before construction upon a commercial, residential driveway, or small cell right of way area may begin within Lee County, whether that is for a single permit or multiple permits. Once filed with the Lee County Department of Transportation Engineering Services, your permit application should be approved and construction may start.
According to the Lee County Department of Transportation Engineering Services, the Right of Way Bond limit must be equal to 110% of the total cost estimate for the project or $5,000, whichever amount is greater.

The contractor is expected to follow all right-of-way permit rules and applicable construction regulations pursuant to the Lee County, FL Municode. Following the execution of the project, the contractor’s one-year warranty contract must be upheld (the bond’s liability may not be released until a passed warranty inspection has been completed). If the contractor violates any of these terms and does not resolve the matter, the Right of Way Bond financially guarantees that compensation is available to the county or any other damaged party. The Lee County Department of Transportation Engineering Services will likely use funds from the bond claim to hire a new contractor to complete repairs, maintenance, and/or any other construction work needed properly.
