Game promoters that are offering prizes that total more than $5,000 in value must file a surety bond with the Florida Department of Agriculture and Consumer Services (FDACS) seven days prior to the commencement of such game promotion.
Jet Insurance Company provides the Game Promotion Surety Bond to act as a financial assurance to the FDACS that all game promotion regulations will be upheld by the applicant, which includes the fulfillment of prizes offered. If any prize goes unpaid, the surety bond will cover what is rightfully owed to the winner.
According to the Florida Department of Agriculture and Consumer Services, the Game Promotion Bond limit must be equal to the total value of all prizes offered within the game promotion.

Your application for the Game Promotion Bond may be completed online or over the phone (855-296-2663) with a Jet team member. To begin, some general information will be required of you (e.g. contact details, bond limit required, and personal social security number). Once submitted, a Jet underwriter will conduct a quick review of your information. An approved rate will then be sent to your email that is ready for immediate purchase. All you’ll need to do is fulfill the payment due to receive a copy of your receipt and bond form instantly.

The original signed and sealed Game Promotion Bond, along with the completed Game Promotion Filing Packet, must be submitted to the Florida Department of Agriculture and Consumer Services at the following mailing address:

The FDACS requires the surety bond to remain in effect while the game promotion is taking place, as well as six months following the announcement of the winners. A new surety bond is needed for each separate game promotion, therefore the Game Promotor Bond cannot be renewed.

It is important to note that operators/promoters who have conducted game promotions in the State of Florida for five consecutive years without any violations regarding state statutes are exempt from the Game Promotion Bond requirement. However, approval for exemption is still required from the FDACS.
As a game promotor, all you need to do is follow the necessary regulations pursuant to Florida Statutes Title XLVI, Chapter 849, and most importantly, complete the payment of prizes that are offered in the game promotion. If this is not taken care of, the winner has the right to file an official complaint with the Florida Department of Agriculture and Consumer Services.
In cases where the FDACS finds that the complaint is justified, civil action will then be pursued on behalf of the damaged party. And, if the state court rules in favor of the claimant, a claim equal to what is owed to the game promotion winner will be filed on the Game Promoter Bond.
Once Jet receives notice of the official claim, we will contact the game promoter as soon as possible. Further details and documentation of the alleged violation will be requested. Although the case has already been reviewed and investigated by the FDACS and a state court, Jet will still do the same to ensure that a baseless claim is not awarded. If the claim is found to be valid, once again, Jet will complete the claim payment process (claim payouts will never exceed the bond limit). The game promoter is then responsible for reimbursing Jet for the claim payout that was made on behalf of their violation. Failure to do so will result in future difficulties obtaining a surety bond.
