Irondale’s Land Disturbing Bond is required for projects that clear, dredge, excavate, transport, or fill land to the point where erosion and drainage issues may arise. Jet Insurance Company offers this permit bond, required by the City of Irondale, giving the permit holder financial security necessary to protect the City from hazardous conditions and damages caused from erosion.

The application and bond purchase process with Jet takes minutes online. We will need basic permit information and the property owner’s (permit holder) information. Once the purchase is complete you will receive a copy of the body and receipt of purchase.

Once effective, the bond must remain active for one full year. After the first year it can be cancelled by Jet’s request to the City. The bond has a 30-day cancellation period, essentially making the bond term one year and one month long. Return on premium will only be possible if a second term needs to be purchased and the bond is cancelled before the term expires.
The City of Irondale holds all the cards and determines how long the bond must be active. You must keep the bond active as long as they determine. Jet will let you know if the bond is about to expire and more premium will be required. The City will also determine when Jet will be relieved of liability. You are not charged for premium during the period between the bond cancellation and release of liability.

If not corrected, the City will take the following actions until corrected: submit notice of violation, issue compliance order, and last issue a cease and desist. Court action is on the table, as well, followed by fines and even jail time.
A claim may be made on the permit bond if the permit holder is unable or unwilling to provide the City with their demanded restitution. Jet will defend you as best we can, but it may be limited to a malfeasance defense if the City has already conducted an investigation and offered a path of mitigation.
Jet will make a payment up to, but not exceeding, the bond amount for any valid claim. A bond claim that Jet makes payment for means the permit holder was unable or unwilling to pay the City, but they are still responsible for any amount Jet pays out and will then owe Jet. This is precisely how all surety bonds and companies operate. We guarantee money for the government and its constituents, but only charge a minimal amount so people can get on a job or get a permit. In the end the responsibility to pay for the damages remains with the person who caused them.
