Any person planning to perform digging or excavation in or under streets, sidewalks, or within any public right-of-way in the City of Helena, Alabama must obtain a permit and surety bond. Jet provides the Performance and Repair Bond as a guarantee to the City of Helena that compensation is available should the contractor default on their contract and fail to abide by the ordinances and regulations they are bound to.
The City Office requires this bond as it is responsible for regulating certain licenses and permits to ensure the safety and well-being of Helena’s people and lands.

The City Clerk at the Building, Planning & Development Department will determine the bond amount so that it is sufficient to repair or replace any right-of-way to the pre-work conditions. The minimum bond limit is $1,000, but increases depending on the scope of work being performed.

The bond cannot be cancelled, as it is needed for the duration you are performing digging or excavation work. However, if you have questions or there are any necessary changes needed on the bond, you can email us as [email protected].
If the bond needs to be effective past the expiration date to line up with an extended permit, let Jet know and we can take payment to ensure the bond stays active with the City. The excavation site is not to be closed until the line, cable, pipe, or other object laid or repaired has been inspected by the City Engineer. Upon completion and a good final inspection, you and the Surety (Jet) will be released of liability under the bond.
Ordinance Number 671-05 lists the rules and regulations for contractors performing right-of-way excavating work in the City of Helena, Alabama. As long as the Ordinance is followed, claims can be easily avoided. For example, a typical claim occurs when a contractor fails or refuses to complete a job and then doesn’t comply with the City’s request to make payment to complete the work.
Most often, other penalties are assessed prior to the bond being used to complete a job. Any person in violation of the Ordinance is guilty of a misdemeanor and risks losing their business license and permit. It is in the best interest of the contractor to resolve any issues immediately as to avoid disciplinary action, including a bond claim.
Should a claim occur, Jet will review all details prior to making the claim payment. During this time, Jet may ask for additional information and documentation to support the investigation. However, any valid claims will be paid out to the claimant up to the full limit of the bond. Under the Ordinance,contractors are liable for their actions, and therefore must restore the claim amount by reimbursing Jet.
